Anderson Partners LLC has extensive experience with the creation and financing of charter schools throughout the State of Indiana. While the process of developing a charter school can be complicated and difficult, the attorneys of Anderson Partners are experienced in guiding clients through this process. Our experience allows us to provide guidance and advice through the entire process of charter school development and financing including obtaining a charter, formation of proper organizational structure, developing a viable financing structure, obtaining financing, and addressing applicable federal tax matters.

Our services include:

  • Assisting with obtaining a charters from the City of Indianapolis and Ball State University;
  • Advising and preparing necessary documentation for the formation of proper organizational structure;
  • Negotiation of charger school agreements and necessary or desirable waivers;
  • Advising charter schools on various funding sources including: the use of separate corporations and building corporations for bond financing; the rules for approaching school districts for inclusion in the school district bond financing; financing through the Indiana Department of Education and the Indiana Finance Authority; financing including New Market Tax Credit funding, IFF, Self Help and the Charter School Development Corporation;
  • Assisting charter schools with the procurement of funding;
  • Advising charter schools regarding the incorporation, governance and procedural rules and regulations applicable to charter schools;
  • Serving as Borrower’s counsel for charter schools obtaining financing; and
  • Serving as Bond Counsel for charter school transactions.

Anderson Partners’ attorneys are familiar with the incorporation, governance and procedural rules and regulations applicable to charter schools and as a result have helped its clients properly form charter schools. Anderson Partners has helped charter schools obtain charters from the City of Indianapolis and Ball State University. We have also negotiated charter school contracts and necessary and desirable waivers. Our attorneys have served as borrower’s counsel for charter schools seeking facilities financing. We have advised charter schools on the use of separate corporations and building corporations for bond financing, the rules for approaching school districts for inclusion in the school district bond financing, and alternatives for financing through the Indiana Department of Education and the Indiana Finance Authority, including New Market Tax Credit funding, IFF, Self Help and the Charter School Development Corporation.
